executive order 13943 of august 6, 2020 (addressing the threat posed by wechat, and taking additional steps to address the national emergency with respect to the information and communications technology and services supply chain); and executive order 13971 of january 5, 2021 (addressing the threat posed by applications and other software developed or controlled by chinese companies). the order directs heads of executive departments to promptly take steps to rescind any orders, rules, regulations, guidelines, or policies, or portions thereof, implementing or enforcing the now revoked orders. consistent with that directive, the secretary of commerce has rescinded the prohibitions implemented under those executive orders. view federal register notice here. to implement provisions of executive order 14034, “protecting americans' sensitive data from foreign adversaries” (e.o. 14034), on november 23, 2021, the department of commerce proposed an amend its final rule on securing the information and communications technology and services supply chain (supply chain rule), which was published on january 19, 2021 (86 fr 4909). the proposed rule would provide additional criteria for the secretary of commerce to consider when determining whether the information and communications technology and services (icts) transactions that involve connected software applications present an undue or unacceptable risk (as defined in the supply chain rule) to u.s national security, critical infrastructure, the digital economy, or the safety of u.s. persons. the proposal also makes conforming changes by revising the definition of icts to expressly include “connected software applications” and add a definition of “connected software application” consistent with e.o. 14034. the comment period for the proposed rule ended on january 11, 2022, and in response to the posting, the department received comments from individuals, trade associations, and industry members. these comments will be considered in the final rule. federal register notice
